by jasontromm
n a major victory for backers of San Diego's Mt. Soledad cross, an appeals court ruled today in favor of a voter measure that authorized transfer of the land beneath the memorial to the federal government. A panel of justices from the 4th District Court of Appeal ruled 3-0 that Proposition A was constitutional, overturning a decision by Superior Court Judge Patricia Yim Cowett that invalidated the measure. The court also reversed a $275,000 attorney fee award received by an ACLU-backed lawyer for plaintiff Phillip Paulsen, an atheist who died last month.

A Matter of Appearances

by jasontromm (via)
When Judge Anna Diggs Taylor was given the job of deciding whether the Bush administration’s wiretapping program was unconstitutional, she certainly understood that she would be ruling on one of the most politically charged cases in recent history. So it would have been prudent for her to disclose any activity that might conceivably raise questions about her ability to be impartial. Regrettably, it was left to a conservative group, Judicial Watch, to point out her role as a trustee to a foundation that had given grants to a branch of the American Civil Liberties Union, a plaintiff in the case.

by jasontromm, 1 comment
An Indiana judge fed up with teenage traffic violators is kicking them in the seat -- the driver's seat. Porter Superior Judge Julia Jent is sentencing the ticketed teens to the embarrassment of riding the school bus, if they are found guilty in her courtroom. The judge, said she knew she had reached the teen when the girl started crying outside her courtroom. With that, she figured she found the right punishment. "Oh my God, you would have thought I gave her and her mother the death penalty," Jent told the paper.

The 10 Most Harmful Government Programs

by jasontromm (via)
Each judge was asked to nominate a few programs for the 2006 list of the 10 Most Harmful Government Programs. We then sent them ballots listing the nominated programs. They ranked their choices 1 through 10, with No. 1 being the program they believed to be "most harmful." A program earned 10 points for each No. 1 vote it received, 9 points for each No. 2 vote, and so on. ()()One program that didn't make the list was the "War on Drugs." I think that belongs at No. 1.

Fundraising Foolishness

by jasontromm
This week, more than two months after President Bush nominated him, the Senate will finally vote on Judge Samuel Alito’s elevation to the Supreme Court. In a final, all-too-typical move, the vote was put off a week at the behest of Alito’s opponents. Why? Nobody seriously expects another week to make a difference. With a few exceptions, senators probably knew how they were going to vote before the hearings. So, why put off the vote?

Judge Samuel J. Alito, Jr. Surely Will Be Confirmed

by jasontromm
He was going to be subjected to a filibuster. Now it appears that Supreme Court Justice Nominee Samuel J. Alito, Jr. will get an up-or-down vote.

Kennedy 'Exclusively' a Moonbat

by jasontromm
If there is one thing to be learned from the confirmation hearings for Judge Samuel Alito’s nomination to the Supreme Court, it’s that liberal Democrats will waste no opportunity to grandstand for their far left-wing even if that means being misleading with the facts, unprofessional with the questioning, and hypocritical with the insinuations. Case in point is liberal moonbat Ted Kennedy who blasted Judge Alito for being a member of an “exclusive” club of Princeton alumni without mentioning that he is a member of an “exclusive” all-male Harvard club.

Alito nominated, Democrats hide from base

by jasontromm
In the past few years, the Democrats have had to run from big government, gun control, welfare, criminal rights and gay marriage. With the Alito nomination, it looks like the Democrats are going to have to renounce the NARAL ladies or prepare for another sad day after the 2006 elections.
